  1. We are Bacardi India Private Limited (“Bacardi / We / Our”), is a group company of the largest privately held spirits company in the world. Bacardi recognises the importance of privacy, confidentiality and security of your personal data and values the trust you place in us.

  2. This Policy applies to Personal Information or Sensitive Personal Data or Information collected or processed, by Bacardi or through its group companies through this application/ website. Your Personal Information includes information or a combination of information that could directly or indirectly be used to identify you (“Personal Information”).

This Privacy Statement explains how we handle, treat, protect and otherwise process your personal data provided to us and how we use that information in connection with the services or products offered by us. This Privacy Statement is published in accordance with the data privacy laws of India. Please read this Privacy Statement carefully. 5. HOW WE HANDLE PERSONAL INFORMATION

We may share or disclose your Personal Information for purposes consistent with this Privacy Policy in the following situations:

  1. Within our group of companies. For instance, to combine the Personal Information collected about you.

We may share your Personal Information with companies we have hired to provide services for us, such as: perform marketing campaigns, publish our advertisement on websites and social media on our behalf, provide IT services (e.g. platform providers, hosting services, maintenance and support), perform researches and surveys, provide consumer-care services, organize competitions, sweepstakes and contests, manage events. We will ensure that any service provider engaged by us is bound to comply with data protection obligations, process your Personal Information only on documented instructions from us and do not use it for their own purposes.

6. DATA SECURITY AND BREACH

Bacardi adopts reasonable security practices and procedures to protect your Personal Data from unauthorized access, use, damage, modification, disclosure, or impairment while under our control, in accordance with Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 under the Information Technology Act, 2000 and applicable laws.

  2. By using the Platform, you acknowledge the inherent security implications of data transmission over the internet, which cannot always be guaranteed as completely secure. In case of any data breach, Bacardi shall take necessary steps as required by applicable Indian laws and cooperate with the relevant authorities. You are responsible for maintaining the confidentiality of your login credentials and account password, and for all activities carried out through your account, whether authorized by you or not. You must notify Bacardi promptly of any actual or suspected unauthorized use of your account or password.

  3. When we need to share your personal information with third parties in order to sell or deliver our products to you, or because required by the law, the parties receiving your Personal Information will process it independently and will be fully liable for complying with applicable data protection laws.

  4. Our websites and applications may, from time to time, contain links to and from the websites of third parties, or you might interact with us on various social media forums. These websites and social media have their own privacy notices or policies. Please check them before you submit any Personal Information. We are not responsible for the practices employed by third party websites linked to/from our sites nor for the information contained therein.

  5. We may sometimes offer you a service or application in co-operation with partners (for example, co-sponsors or licensors, licensees or distributors, advertising partners and social media platforms). We may therefore disclose your personal information to those partners. This disclosure will happen, depending on its purpose and characteristics, and the applicable legal requirements, based your consent, or our legitimate interest.

  6. We are a multinational company, and our affiliates, partners and service providers are located all around the world; for this reason, your Personal Information may travel internationally. Whenever this happens, we implement appropriate measures to assure the original level of protection is maintained. You may request a copy of any relevant documents in relation to the transfers of your Personal Information.

  7. Where we transfer your Personal Information outside India, such transfers shall be made only if the transferee ensures the same level of protection as is required under applicable Indian law, including the Information Technology Act, 2000 and the rules made thereunder.

The Bacardi App may include links to third-party websites, applications, or services. Your use of such features may result in the collection, processing, or sharing of information with these third parties. Please note that Bacardi is not responsible for the content, security, or privacy practices of such third-party websites or services, and we do not endorse or make any representations regarding them. This Privacy Policy does not govern information you choose to provide to, or that may be collected by, such third parties. We strongly encourage you to review the privacy policies of these third-party websites or services before sharing any personal information with them.

8. YOUR RIGHTS

Subject to possible restrictions under Indian laws, you are entitled to certain rights, such as the right to:

  1. access, review, and correct your Personal Information;

  2. nominate another individual to exercise your rights in the event of your death or incapacity;

  3. withdraw your consent at any time (with effect for the future);

  4. request deletion of your Personal Information, subject to legal or contractual requirements; and

  5. raise grievances with our designated Grievance Officer.

9. RETENTION PERIOD

We retain your Personal Data only for as long as it is needed for the purposes for which it was collected or as required under any applicable law. In some cases, we may retain certain data for longer if it is deemed necessary to provide our services, prevent fraud or misuse, or protect our legal rights.

10. DATA DELETION

You may request deletion of your personal information or withdraw your consent to our use of your information at any time by contacting Grievance Officer. Upon receiving such a request, we will permanently delete or anonymise your personal information and will no longer have access to use it, except where retention is required by law or for legitimate business purposes such as compliance with tax or accounting obligations. Please note that if you withdraw consent or request deletion of information necessary to provide certain services or benefits, we may be unable to continue offering those services to you.

11. CHILDREN

Our website, applications and services are designed to appeal to adults only. We do not knowingly solicit any information from children or people under the legal drinking age, nor do we knowingly market or otherwise target our websites or its products or services to children or people under the legal drinking age. If we become aware that a visitor to our websites is a child or under the Legal Drinking Age in the country or other territory in which he or she is located at the relevant time we will remove their Personal Information from our files.

12. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices, services, or legal requirements. We encourage you to review this Policy periodically. If we make material changes, we will notify you as required by law, for example by posting a notice on the Bacardi App or by sending you an email.
